Yemen TPS discrimination claims survive; renewed preliminary relief denied

The October 6 order dismisses every claim except intentional discrimination in both cases, denies Abdo plaintiffs’ second preliminary-injunction motion and lifts the litigation stays. The October 20 endorsement holds interlocutory-appeal certification and discovery-stay requests in abeyance. An October 30 letter is listed, but its contents and any subsequent ruling remain unverified.

About the case

These related cases challenge termination of Yemen TPS. The August 11 vacatur of the earlier postponement and August 17 voluntary dismissal of the government’s appeals did not resolve the district claims. The related Yemen TPS challenges continue only on intentional-discrimination claims after the October 6, 2026 opinion and order (Noor ECF 71 / Abdo ECF 114) dismissed the other claims with prejudice and denied Abdo plaintiffs’ second preliminary-injunction motion. The previously vacated TPS postponement was not reinstated. On October 20, the court held the government’s requests for interlocutory-appeal certification and a discovery stay in abeyance and directed proposals for further proceedings.

Relief

The earlier TPS postponement remains vacated. The October 6 order denies the second preliminary-injunction motion; survival of the intentional-discrimination claims is not a finding of discrimination or restored TPS protection.

What's next

Further proceedings on the surviving intentional-discrimination claims and disposition of the held certification and discovery-stay requests; verify the October 30 letter and any later order.
