About the case
On September 30, 2026, the Southern District of New York granted plaintiffs summary judgment on their arbitrary-and-capricious challenge to ICE's 2025 courthouse-arrest policy. The court directed vacatur of the January 2025 Interim Guidance and May 2025 Final Guidance only insofar as they rescind the April 2021 Guidance for civil enforcement in or near immigration courts. It granted defendants judgment on Count II and dismissed Counts III-V for lack of jurisdiction after EOIR withdrew its dismissal policy. The case was formerly captioned against Todd M. Lyons.
Relief
The APA vacatur applies to the specified immigration-court portions of the agency guidance without a plaintiff-only limitation. It is not an injunction prohibiting all courthouse arrests and does not vacate the guidance for every type of courthouse.
What's next
Verify subsequent judgment entry and any stay or appeal; the September 30 opinion alone does not establish unappealable finality or docket closure.
New on the docket, not yet reviewed
Nothing new since the last review.
