About the case
CASA, Inc., the Asylum Seeker Advocacy Project and expectant parents sued on January 21, 2025 to block Executive Order 14160. The court preliminarily enjoined the order on February 5, 2025; on June 27, 2025, in Trump v. CASA, the Supreme Court partially stayed that and two other universal injunctions to the extent they were broader than necessary to give complete relief to each plaintiff with standing. The plaintiffs then amended to bring a class action, and on August 7, 2025 the court certified a Rule 23(b)(2) class of "[a]ny child who has been born or will be born in the United States after February 19, 2025" to a mother unlawfully or temporarily present and a father who was not a citizen or permanent resident, and enjoined Executive Order 14160 as to the class. After the Supreme Court decided Trump v. Barbara, the Fourth Circuit granted the government's motion to voluntarily dismiss its appeal (No. 25-2188) on August 14, 2026. On September 2, 2026 the court enjoined enforcement of Executive Order 14418 against the class, except section 2(d), finding the plaintiffs likely to succeed because Barbara held that the class members are citizens at birth. The government moved on September 8 to dissolve that injunction or stay it pending appeal.
Relief
The 2026 injunction bars the defendants from enforcing or applying Executive Order 14418 against the class representatives and class members, or otherwise interfering with their citizenship. It does not enjoin section 2(d), which concerns births in territories, and lets the agencies issue public guidance under section 3(b). The August 7, 2025 injunction against Executive Order 14160 remains in effect (ECF 182 ¶ 5).
