About the case

On September 30, 2026, the Northern District of California partially granted preliminary relief in Global Nurse Force v. Trump. The court vacated and remanded agency policies implementing the $100,000 H-1B payment requirement under Proclamations 10973 and 11069, and barred implementation until required APA notice-and-comment procedures and Regulatory Flexibility Act analyses are completed. The order does not enjoin the proclamations themselves and denies provisional class certification without prejudice. On October 9, the government appealed ECF 130 to the Ninth Circuit and requested a stay of further district proceedings. Its motion states that the existing vacatur would remain in place under the requested stay; it is not an order staying the preliminary relief. The Ninth Circuit's October 9 time-schedule notice assigns appeal 26-6667, with the opening brief due November 6, the answering brief due December 4, and an optional reply within 21 days after service of the answering brief. The notice establishes appellate briefing dates without granting a stay. A minute entry filed October 28, 2026, ECF 144, records denial of the government’s motion to stay district proceedings. This procedural ruling does not stay the September 30 preliminary relief. The entry contains inconsistent conference and deadline dates, so its new scheduling dates require clarification.

Relief

The agency-policy vacatur is not limited to the moving plaintiffs. The injunction covers the agency defendants' implementation of those policies pending APA notice and comment and RFA analyses; the proclamations themselves are not enjoined.

What's next

The previously verified appellate schedule sets November 6 opening and December 4 answering briefs. A clarified district scheduling entry is needed before relying on ECF 144’s administrative-record and further-conference dates.
