Accordingly, the Court construes Defendants' 12 response as a motion to remand to USCIS. Plaintiff does not oppose remand to USCIS, and in fact encourages it, but requests that the remand afford USCIS only 21 days, not 45 days, to adjudicate her application. Plaintiff's only argument for a 21-day period is that other orders in this District have provided for either 21-day or 30-day periods in similar circumstances, (see Dkt. 13, at 2; see also Dkt. 12, at 2-3 (collecting cases)), but this is an entirely discretionary decision for the Court. Plaintiff points to no particular harm or prejudice that will result from permitting USCIS 45 days to adjudicate her application other than the potential for limited delay. The Court grants the motion to remand and hereby orders that Plaintiff's Complaint and all claims therein are remanded to USCIS pursuant to 8 U.S.C. § 1447(b), without costs, expenses, or attorneys' fees to any party, subject to the following condition: This remand is without prejudice to Plaintiff's right to reinstate this action if USCIS does not render a decision on Plaintiff's application for naturalization (Form N-400) within forty-five (45) days of this Order. On May 26, 2026, Defendants filed a pre-motion conference letter 7 in anticipation of a motion to dismiss for lack of subject-matter jurisdiction and explaining that, on April 6, 2026, U.S. Citizenship and Immigration Services (\"USCIS\") issued Plaintiff's spouse an interview notice in connection with her I-130 application. Defendants represent that the asylum interview was scheduled for May 12, 2026, and on May 12, 2026, USCIS issued a notice approving Plaintiff's spouse's I-130. See [7-1]. The Court ordered Plaintiff to respond to the Defendants' letter by June 3, 2026. Plaintiff has not responded. The Administrative Procedure Act permits federal courts to compel agency action that has been \"unlawfully withheld or unreasonably delayed,\" 5 U.S.C. § 706(1), unless another statute precludes judicial review. 5 U.S.C. § 701(a)(1). USCIS's approval of the I-130 application demonstrates the absence of the agency-inaction predicate of an undue-delay suit. As Defendants have approved the I-130 application, Plaintiff's writ of mandamus is now moot. Accordingly, the complaint is dismissed for lack of subject-matter jurisdiction. Under 8 U.S.C. § 1447(b), \"a naturalization applicant can bring a petition to the district court when United States Citizenship and Immigration Services has not decided the application for more than 120 days\" after the applicant's initial examination. Bustamonte v. Napolitano, 582 F.3d 403, 403-04 (2d Cir. 2009). While a proper Section 1447(b) petition vests jurisdiction in this Court, id. at 409, this Court may \"determine the matter directly,\" or \"remand the matter, with appropriate instructions, to the Service to determine the matter.\" 8 U.S.C. § 1447(b). Courts in this Circuit appear to find that this decision rests with the Court's equitable discretion. Althnaibat v. Wolf, No. 19-CV-3245, 2020 WL 4883890, at *3 (S.D.N.Y. Aug. 18, 2020); Tochaei v. Kelly, No. 17-CV-654, 2018 WL 1768276, at *2 (N.D.N.Y. Apr. 12, 2018).The Court exercises that discretion to remand this case to USCIS. The USCIS is \"charged with primary naturalization responsibility.\" See Ajlani v. Chertoff, 545 F.3d 229, 241 (2d Cir. 2008). \"Generally speaking, a court of appeals should remand a case to an agency for decision of a matter that statutes place primarily in agency hands.\" INS v. Orlando Ventura, 537 U.S. 12, 16-17 (2002); Tochaei, 2018 WL 1768276, at *2. Though plaintiff may be differently positioned from the petitioner in INS v. Orlando Ventura, as he observes in his 30 supplemental response, the Supreme Court's admonition that agencies are better equipped than this Court to handle immigration matters applies broadly--and to this case. Given USCIS's expertise in assessing naturalization applications, Ahmed v. Rosen, No. 21-CV-76, 2021 WL 612300, at *1 (E.D.N.Y. Feb. 17, 2021), and given the agency's commitment to issuing a prompt decision within 60 days of remand, Def.'s Letter 3 (Dkt. #27), this Court favors remanding even if \"the administrative record\" might be \"fully developed\" at this juncture, Pl.'s Resp. 1 (Dkt. #29). If plaintiff is correct that USCIS would wrongfully deny his application, he may seek de novo review from this Court under 8 U.S.C. § 1421(c). For the foregoing reasons, the 27 motion for remand is granted. Plaintiff's complaint is hereby remanded to USCIS pursuant to 8 U.S.C. § 1447(b), without costs, expenses, or attorneys' fees to any party. This remand is without prejudice to plaintiff's right to reinstate this action if USCIS does not render a decision on plaintiff's Form N-400, Application for Naturalization within sixty (60) days of this order. Plaintiff suggests that USCIS will fail to timely resolve his naturalization application, introduce fabricated evidence, and violate his rights under the Due Process Clause and the Rehabilitation Act.
