Plaintiff seeks an order compelling Defendants to return him to the United States. He characterizes this action as challenging \"the execution of his removal order\"; \"Defendants' wrongful interference with his [Temporary Protected Status] application\" when Defendants failed to produce him for a biometrics appointment while he was detained upon a final order of removal; and \"the denial of interim temporary treatment benefits\" under the TPS statute, which he contends should have prevented Defendants from removing him until the final adjudication of his TPS application. Dkt. 27 at 15.The Court cannot hear this case. 8 U.S.C. § 1252(g) deprives this Court of jurisdiction to review removal orders, including their \"execut[ion].\" This suit falls within the exclusive review system that § 1252(g) establishes. See Thunder Basin Coal Co. v. Reich, 510 U.S. 200, 212-13 (1994). First, Plaintiff could have, but did not, appeal his removal order to the Bureau of Immigration Appeals (BIA) and then a Circuit Court. Id. Second, Plaintiff's claims are not wholly collateral to review of his removal order because he challenges \"the execution of his removal order\" and his inability to attend a biometrics appointment while detained on a final order of removal, Dkt. 27 at 15. Thunder Basin, 510 U.S. at 212-13. Third, the BIA is fully capable of adjudicating alleged deficiencies associated with removal orders. Id. Even if Plaintiff's claim of interference with his TPS application was not enmeshed in the execution of his removal order, Plaintiff identifies no legal requirement that Defendants produce him for his biometrics appointment and so has failed to state a claim. See Fed. R. Civ. P. 12(b)(6). For similar reasons, the Court has no jurisdiction under the Mandamus Act. See Muthana v. Pompeo, 985 F.3d 893, 910 (D.C. Cir. 2021) (permitting mandamus relief only if a plaintiff has a clear right to relief, the defendant has a clear duty to act, and there is no other adequate remedy available). And the Declaratory Judgment Act and All Writs Act, under which Plaintiff asserts claims, do not serve as independent grants of jurisdiction. See Miriyeva v. U.S. Citizenship & Immigr. Servs., 9 F.4th 935, 945 (D.C. Cir. 2021); In re Nat'l Nurses United, 47 F.4th 746, 752 (D.C. Cir. 2022).In addition, \"[t]here shall be no appeal from the denial of temporary treatment benefits.\" 8 C.F.R. § 244.5(c). (USCIS \"grant[s]\" these benefits upon a prima facie showing of eligibility for TPS. Id. §244.10(a). That grant \"shall be evidenced by the issuance of an employment authorization document,\" id. §244.10(e)(1), which Plaintiff does not indicate he obtained.) Ultimately, Plaintiff cannot point to a single analogous case where a federal district court has (1) assumed jurisdiction; (2) recognized a claim under the statutes that Plaintiff identifies or the Due Process Clause; and (3) ordered a plaintiff returned to the United States. Dkt. 1 at 10-13; Dkt. 26-1 at 11-15. Rather, all the cases Plaintiff offers in which a court has ordered an individual returned involve the deprivation of a right or immigration status to which a plaintiff was legally entitled and/or a Circuit Court's review of an order of removal under 8 U.S.C. § 1252. See Dkt. 27 at 22. The Court GRANTS Defendants' Motion to Dismiss. Because in the above analysis, the Court considered Plaintiff's proposed Amended Complaint but determined it still must dismiss this case, the Court also DENIES as moot Plaintiff's Motion for Leave to Amend. The Court further DIRECTS the Clerk of Court to terminate this action. Signed by Judge Ana C. Reyes on 2/10/2026. Given the content of plaintiff's 9 response, which was submitted in response to the 8 Order after the case had already been dismissed, the Court will deem it to be a motion to alter the judgment under Federal Rule of Civil Procedure 59, and will DENY the motion. Defendant moved to dismiss the case because, in the absence of a waiver of sovereign immunity, the Court lacked jurisdiction over plaintiff's claim for compensatory damages. While, in his response, plaintiff suggests that his concern is not simply monetary, a review of the complaint reveals that he made no claim and sought no relief other than compensatory damages. And therefore, if his opposition to the motion to dismiss had been received in time, it would not have changed the results, and it does not now provide grounds to alter the judgment. The Court's ruling is without prejudice to a case that is filed in the appropriate venue the United States District Court for the District of Vermont, where the Vermont Service Center is located, or the District of Maryland, where plaintiff resides and that is served on the proper parties, alleges unreasonable delay, and seeks injunctive relief only.
